terms and conditions

The following terms and condition of use (the “T&Cs”) govern your participation in the Randstad Interim Inc. (“Randstad Canada”) Talent Referral Program (the “Program”) and your use and access to the Program’s portal website located at [www.randstad.ca/job-seeker/referral/] (the “Site”).  

The Program is for a limited time only. Randstad Canada may, in its sole discretion, revise these T&Cs at any time by updating the T&Cs posted on the Site, without any prior notice or liability to you or any other person. You should visit the “Terms and Conditions” page on the Site periodically to review these T&Cs for any changes or updates, because they are binding on you. 

References to “we”, “us” or “our” in these terms and conditions are to Randstad Canada and also includes, where applicable, our affiliates, service providers, suppliers and sub-contractors. The terms "you" and “your” as used in these T&Cs refer to all individuals and/or entities participating in the Program.


By accepting these T&Cs and/or participating in the Program, you agree to be bound by these terms and conditions and the documents referred to in them, and that, to the best of your knowledge, the information you provide to the Randstad Canada, its representatives or agents, is complete and accurate. A false statement may disqualify you from participation in the Program. If you do not agree or accept any of the T&Cs stated here, you will not be entitled to participate in the Program. 

You acknowledge that your compliance with these T&Cs is a condition of your participation in the Program. Any non-compliance with these T&Cs may result in your immediate removal from the Program at Randstad Canada’s sole and absolute discretion.

talent referral

Through the Site, Participants may refer friends, colleagues, family members or acquaintances to Randstad to be considered for assignments with Randstad’s clients on a temporary basis (“Referred Candidates”). By submitting an individual Referred Candidate, the Participant certifies that the Referred Candidate has either (i) an existing business relationship, (ii) an existing non-business relationship, (iii) a family relationship; (iv) or a personal relationship with the Participant.

By submitting a referral, Participant consents to Randstad Canada contacting the Referred Candidate and including the Participant’s full name and any details of the referral submitted by the Participant through the Site in any communications to or with the Referred Talent.


Participants must be resident in Canada. Internal employees of Randstad Canada and its affiliates are not eligible for participation in the Program.

In order to be eligible, a Referred Candidate must not have had contact with a Randstad Canada recruiter or submitted an application to Randstad Canada in the 12 months immediately prior to the date of submission by the Participant. The Participant will not be entitled to any Referral Award (as defined below) with respect to a Referred Candidate who does not meet the above eligibility criteria.  In the event that the same Referred Candidate is referred by another Participant, only the Participant who first referred the Referred Candidate will be entitled to any Referral Award.

Randstad Canada reserves the right to make the final determination on a Referred Candidate’s eligibility or a Participant’s entitlement to a Referral Award in its sole and absolute discretion.

You acknowledge and agree that Randstad Canada will contact, interview and screen Referred Candidates in accordance with its usual vetting process and any other additional client screening requirements. Randstad Canada is under no obligation whatsoever to hire or engage any Referred Candidate and may refuse any Referred Candidate for any reason whatsoever. Randstad Canada is under no obligation to provide Participants with any status update or any other information regarding its engagement with any Referred Candidate.

referral awards

Each Referred Candidate who is successfully hired or engaged by Randstad Canada and completes a minimum placement length of 8 consecutive weeks (the “Minimum Placement Length”) on assignment with a client of Randstad Canada will be considered a “Successful Candidate”. If the Referred Candidate leaves a position or their placement ends for any reason (including, without limitation, voluntary resignation, termination with or without cause, death or incapacity) prior to completion of the Minimum Placement Length, no Referral Award will be payable with respect to that Referred Candidate.

For each Successful Candidate, the Participant shall be entitled to receive a one-time award (the “Referral Award”) in an amount between CAD $25-$500 (amounts will vary based on the region and role of the Referred Candidate). The maximum aggregate total Referral Awards payable to each Participant may not exceed $500 per calendar year. 

The Referral Award will be the sole form of compensation payable to Participants under the Program. Participants will not have the right to claim or seek reimbursement for any expenses or other costs incurred in connection with their participation in the Program. Referral Awards will be paid to Participants by way of a pre-paid Tango credit card, which will be mailed to the Participant at the address provided through the Site approximately 30 days following the completion of the Minimum Placement Length.

All payments of Referral Awards shall be made by Randstad Canada without statutory deductions in respect of, but not limited to, the Income Tax Act (Canada), the Canada Pension Plan, the Quebec Pension Plan, the Quebec Parental Insurance Plan, the Employment Insurance Act (Canada), provincial health premiums or taxes (if applicable) or otherwise.  Participant acknowledges responsibility for arranging, paying and remitting all applicable payments, contributions, premiums or penalties under any federal or provincial legislation with respect to their services provided under this Agreement. 

Randstad Canada reserves the right to withhold payment of any Referral Award in the event you materially breach any representations, warranties and covenants set forth herein. 

independent status

You agree that parties agree that:

a) your participation in the Program does not create a fiduciary or trust relationship between the parties;

b) you are not an agent, employee or independent contractor of Randstad and your participation in the Program does not, and intended to, make either party an agent, legal representative, subsidiary, joint venturer, partner, employee, or servant of the other party;

c) your participation in the Program is completely at your discretion; and

d) you are not authorized to make any contract, agreement, warranty, or representation on behalf of Randstad Canada, or to incur any debt or other obligation is not in Randstad Canada’s name.

limitation of liability

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Program or the Site, whether express or implied. We will not be liable you or any other party for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with participation in the Program or any information provided in connection therewith. 



If you want to terminate your participation in the Program, you may only cease your use of the Site and we will not be responsible for maintaining or returning any of your submissions or other materials provided to us.

privacy policy

By using the Site and/or the Program, you may make available to Randstad Canada certain information about you.  Randstad Canada collects, uses, and discloses information regarding your participation in the Program and your personal information in accordance with our Privacy Policy, available at www.randstad.ca/privacy-policy/, the terms and conditions of which are incorporated herein by reference. We will use information supplied by you (including, without limitation, sensitive personal data) to aid in the administration of the Program. This involves us, amongst other things, processing and storing information (including, without limitation, sensitive personal data) in connection with contacting Referred Candidates. We may collect and aggregate data from the information supplied by you to help us to understand our users as a group so that we can provide you with a better service. We may also share aggregate information with selected third parties, without disclosing individual names or identifying information. You consent to us using information provided by you (including, without limitation, sensitive personal data) in each of these ways. We will process any data which you provide in completing the online registration or application forms and any further forms, assessments or personal details which you complete or provide to us through the Program in accordance with applicable data protection legislation.  By accepting these terms and conditions, and each time you participate in the Program, you consent to the collection, use and disclosure by Randstad Canada of your personal information in accordance with our Privacy Policy, including any updates, without any further notice to you or any liability to you or any other person.

exclusive jurisdiction

These terms and conditions, and any matter applicable to your direct or indirect use of the Program, shall be governed by the laws of the Province of Ontario and the Federal laws applicable in the Province of Ontario. Any dispute shall be settled in the courts located in the Province of Ontario, though the foregoing shall not limit the ability of Randstad Canada from seeking injunctions and remedies in other jurisdictions which are required to stop continuing breaches of this Agreement by you.
